1. Acceptance of Terms
By accessing or using the HeirTrust website, platform, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
HeirTrust is a decentralized protocol designed for ownership continuity of digital and tokenized assets. The Service allows users to create smart contract vaults, configure automated transfer rules, and designate beneficiaries for their digital assets. HeirTrust operates as a non-custodial platform—at no point does HeirTrust take custody or control of your assets.
3. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements and that your use of the Service does not violate any applicable law or regulation in your jurisdiction.
4. User Responsibilities
- You are solely responsible for maintaining the security of your wallet credentials, private keys, and any authentication mechanisms associated with your account.
- You are responsible for the accuracy of all information provided through the Service, including beneficiary designations and transfer conditions.
- You agree not to use the Service for any unlawful purpose, including but not limited to money laundering, fraud, or the circumvention of sanctions.
- You acknowledge that blockchain transactions are irreversible once executed and that HeirTrust cannot reverse or modify completed transfers.
5. Non-Custodial Nature
HeirTrust is a non-custodial protocol. You retain full ownership and control of your digital assets at all times. HeirTrust does not have access to your private keys, wallet credentials, or the ability to move your funds. All asset transfers are executed solely by smart contracts deployed on public blockchains according to the rules you configure.
6. Smart Contract Risks
While HeirTrust smart contracts undergo security audits, the use of blockchain technology and smart contracts carries inherent risks, including but not limited to software bugs, network congestion, protocol vulnerabilities, and changes to underlying blockchain infrastructure. You acknowledge and accept these risks when using the Service.
7. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are owned by or licensed to HeirTrust. You may not reproduce, distribute, or create derivative works from any content on the Service without prior written consent from HeirTrust.
8. Limitation of Liability
To the maximum extent permitted by applicable law, HeirTrust and its team members, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of digital assets, data, profits, or goodwill, arising out of or related to your use of the Service.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. HeirTrust does not guarantee uninterrupted or error-free operation of the Service. HeirTrust does not provide financial, legal, or tax advice. You should consult qualified professionals regarding your specific circumstances.
10. Modifications to Terms
HeirTrust reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
11. Termination
HeirTrust may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.
